Das im Bilde des Absoluten verschwindende, um sich daraus wieder abzuleitende, wissende Ich einerseits und die religiös bestimmte Einstellung des lebendigen Subjekts zu seinem Grunde und zur gegenständlichen Welt andererseits können als Vertiefung früherer Fassungen betrachtet werden. Eben diese Begriffskonstellation versuchen wir im Folgenden näher zu untersuchen, und zwar aus dem Gesichtspunkte der Schellingschen Philosophie der Mythologie, denn wir sind der Meinung, dass erst diese Perspektive den eigentlichen Sinn und den wahren Ort der Fichteschen Lehre vom Absoluten sehen lässt. Zusammenfassung Die Zahl jener Akteure, die sich in ihrer Freizeit exzessiv und unter Absehen der dadurch ausgelösten psychischen, physischen und sozialen Konsequenzen dem Sport hingeben, ist in den letzten Jahren stark angestiegen. Sportmedizin und Sportpsychologie haben hierfür den Begriff „exercise addiction“ geprägt und eine Vielzahl wichtiger Erkenntnisse hervorgebracht. Im Unterschied zu der in diesen Disziplinen üblichen Vorgehensweise, die psychischen und physischen Aspekte des Themas personalisierend in den Vordergrund zu rücken, um das stoffungebundene Suchtverhalten im Sport zu erklären, wählt der vorliegende (...) Beitrag einen soziologischen Zugang. Die Sportsucht wird folglich als soziales Phänomen behandelt und analytisch auf einer makro-, meso- und mikrogesellschaftlichen Ebene verortet. Die soziokulturellen Bedingungen sportsüchtigen Handelns lassen sich so präzise herausarbeiten. Vor allem wird auch deutlich gemacht, warum immer mehr Menschen gerade den Sport als Suchtfeld nutzen. Damit präsentiert der Text erstmalig den Entwurf einer Soziologie der Sportsucht. (shrink)

Zusammenfassung Die Einführung von Impfprogrammen bei einer immun-naiven Bevölkerung in Europa spielte eine wesentliche Rolle für den Verlauf der COVID-19 Pandemie. Vor allem zu Beginn waren Impfprogramme jedoch durch einen Mangel an Impfdosen gekennzeichnet. Bei einer Zuteilung geringer Dosen an Krankenhäuser in der Initialphase, waren Krankenhausleitungen durch eine möglichst faire Verteilung dieser Impfdosen unter dem Krankenhauspersonal gefordert. Der Beitrag dokumentiert das Vorgehen im ersten Quartal 2021 an fünf deutschen Krankenhäusern in einem Klinikverbund. Wir berichten über einen regel-konsequentialistischen Ansatz auf der (...) strategischen Ebene, der durch einen egalitären Ansatz auf der taktischen Ebene ergänzt wurde. Es erfolgte die ethisch begleitete Entwicklung eines hybriden Schemas unter Verzicht auf klassische Verteilungsmuster, wie dem First-Come-First-Served Schema. Die Kombination des strategischen regel-konsequentialistischen Schemas mit egalitärer Verteilung auf der taktischen Ebene war vollständig funktional und unter den Mitarbeitenden des Klinikverbundes gut akzeptiert. In Zeiten von Pandemien und knappen Ressourcen spielt die Verteilung von medizinischen Gütern für die Funktionalität medizinischer Einrichtungen eine wichtige Rolle. Die Verteilung von Gütern, die durch den Staat bereitgestellt werden, bedarf jedoch einer Anpassung an die jeweiligen Gegebenheiten der Institutionen. Dieser Bericht zeigt eine mögliche Option für die Verteilung knapper Impfdosen auf, die nicht nur unter Personen der Zielgruppe verteilt wurden, sondern die auch die Funktionalität der medizinischen Versorgung in einer Region sicherte. Der Gedanke, der sich in der modernen Idee der Autonomie verdichtet, ist ein doppelter: Die Figur der Autonomie enthält zugleich eine neue Auffassung von Normativität und eine eigene Konzeption von Freiheit. Dem Gedanken der Autonomie zufolge ist ein Gesetz, das wahrhaft normativ ist, eines, als dessen Urheber wir uns selbst betrachten können; und eine Freiheit, die im vollen Sinne wirklich ist, drückt sich in Gestalt eben solcher selbstgegebener Gesetze aus. Die Idee der Autonomie artikuliert so die Einsicht, dass man (...) Freiheit und Gesetz nicht durch ihre Entgegensetzung bestimmen kann, sondern durcheinander erläutern muss. Wirkliche Freiheit ist nicht Freiheit von Gesetzen, sondern Freiheit in Gesetzen; verbindliche Normen sind nicht das, was Freiheit äußerlich beschränkt, sondern das, was Freiheit innerlich verwirklicht. Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

Da gegenwärtig kein allgemeinverbindlicher Begriff des ‚Neukantianismus‘ oder gar der ‚Transzendentalphilosophie‘ zur Verfügung steht und somit unter heutigen Bedingungen nicht aufs Geratewohl eine Geschichte der transzendentalsystematischen Bemühungen des 20. Jahrhunderts verfaßt werden kann, lag es nahe, sich diesem Thema anhand einer Analyse der Diskussionen zu nähern, in denen sich die sogenannte Selbstauflösung des Neukantianismus dokumentiert. Im Zuge dieser Annäherung war insbesondere an Siegfried Marcks zweibändiges Werk über DIE DIALEKTIK IN DER PHILOSOPHIE DER GEGENWART (Tübingen 1929/31) anzuknüpfen, das die transzendentalphilosophische Diskussion (...) der 20er Jahre unter dem Aspekt einer „kritischen Dialektik“ zusammenfaßt; einer kritischen Dialektik, die sich aufgrund der Ablehnung der neukantianischen „Konstruktion eines idealen Subjekts“ und der darum nunmehr verstärkten Einsicht in die „Spannung zwischen dem existierenden Subjekte und dem Geltungsbereich“ ausgeformt habe und als das verbindende Motiv in „Jonas Cohns Theorie der Dialektik, R. Höngswalds Denkpsychologie, Br. Bauchs Ideenlehre, P. Natorps Lehre vom Grenzdenken, N. Hartmanns Aporetik, E. Cassirers philosophische[r] ‚Anthropologie‘, Max Adlers neukantische[m] Marxismus“ anzusehen sei (S. Marck [1929], S. III). Wie allein schon der Hinweis auf „N[icolai] Hartmanns Aporetik“ zeigt, geht diese,Hegel-Renaissance in der deutschen Philosophie‘ (H. Levy) auch Hand in Hand mit einer Ontologisierung der Transzendentalphilosophie. Dieser Transzendentalontologie, die sich - teils in dialektischem Einverständnis mit und teils in antidialektischem Gegensatz zur ‚Hegel-Renaissance‘ - mit einer nach den unterschiedlichsten Richtungen hin wirksamen ‚Leibniz-Renaissance‘ verband, war im Titel der vorliegenden Untersuchung um so mehr Rechnung zu tragen, als das ontologische Motiv (vorallem unter dem Eindruck der Hartmannschen Neo-Ontologie und der Heideggerschen Existentialontologie) in den transzendentalsystematischen Arbeiten der Nachkriegszeit eindeutig in den Vordergrund tritt. Der Titel KRITISCHE DIALEKTIK UND TRANSZENDENTALONTOLOGIE steckt daher sowohl den inhaltlichen wie auch den zeitlichen Rahmen der Untersuchung ab: ihr Thema sind die post-neukantianischen Systembildungen, die in Auseinandersetzung mit den dominierenden Philosophemen der Zwischen- und Nachkriegszeit (der Neo-Ontologie und der Lebens- und Existenzphilosophie) am transzendentalen Ansatz und Systemanspruch festhielten, indem sie den überzeitlichen Geltungsanspruch der Idee und die innerzeitliche Existenz ‚dialektisch‘ oder ‚monadologisch‘ zu vermitteln suchten. Nachdem aus transzendentalsystematischer Sicht das Ringen um eben diese Vermittlungsproblematik ohnehin die gesamte abendländische Philosophiegeschichte ‚seit Parmenides und Platon‘ beherrscht, sagt diese Eingrenzung der Thematik allerdings mehr über das Selbstverständnis der Systemdenker aus, als sie zu deren philosophiegeschichtlicher Positionierung beiträgt. Man kommt daher dem Eigentümlichen der post-neukantianischen Systembildungen näher, wenn man – ihre Differenz zum Neukantianismus hervorhebend – betont, daß sie sich aufgrund der Ablehnung der neukantianischen „Konstruktion eines idealen Subjekts“ (S. Marck) dem Problem der ‚Konkretisierung der Transzendentalität‘ (Erich Heintel) oder einer ‚Philosophie der konkreten Subjektivität‘ (Hans Wagner) stellen. Da man die Phänomenologie Husserls und die Philosophische Anthropologie in gleicher Weise charakterisieren kann, muß diese Problemstellung in unserem Zusammenhang freilich nicht so sehr als Verabschiedung, sondern als Weiterführung neukantianischer Traditionen verstanden werden; da der Versuch einer Rekonstruktion der neukantianischen Theoriestränge, die sich gegenüber den lebensphilosophischen, ontologischen und positivistischen Zersetzungen des kritizistischen Ansatzes resistent erwiesen, zur Revision einiger gängiger Vorurteile bezüglich des Neukantianismus zwingt, wird im Zuge der einleitenden Analyse der sogenannten Selbstauflösung des Neukantianismus aber auch der Begriff ‚Neukantianismus‘ selbst in grundsätzlicher Weise zu bestimmen sein. Diese Begriffsbestimmung liefert das gesuchte Kriterium für die systematische Eingrenzung der Thematik und somit für die Auswahl der Repräsentanten der Kritischen Dialektik und Transzendentalontologie, deren philosophische Bemühungen in der Folge dokumentiert sind. Durchaus in Verbindung und Übereinstimmung mit diesen systematischen Erwägungen war für die nähere Auseinandersetzung mit Richard Hönigswald und Wolfgang Cramer, Bruno Bauch und Hans Wagner, sowie mit Robert Reininger und Erich Heintel, nicht zuletzt der Umstand maßgeblich, daß ihre Arbeiten eine für die Philosophie des 20. Jahrhunderts bemerkenswerte Kontinuität transzendentalphilosophischer Ansätze demonstrieren und dennoch keineswegs die Beachtung gefunden haben, die sie im Interesse einer lebendigen Aneignung und kritischen Weiterführung der Transzendentalphilosophie verdienen. Die vorliegende Arbeit versucht vorallem diese Kontinuität transzendentalphilosophischer bzw. neukantianischer Ansätze herauszustellen und die aus der individuellen Problemsicht der genannten Autoren resultierende produktive Weiterbildung dieser Ansätze zu dokumentieren, indem sie jeweils monographisch die einzelnen Denkwege verfolgt. At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. The author's thesis is that there is a conceptually necessary connection between law and morality which means legal positivism must fail as a comprehensive theory. The substantiation of this thesis takes place within a conceptual framework which shows that there are at least 64 theses to be distinguished, concerning the relationship of law and morality. The basis for the author's argument in favour of a necessary connection, is formed by the thesis that individual legal norms and decisions as well as (...) whole legal systems necessarily make a claim to correctness. Philosophy is general and systematic reflection about what there is, what ought to be done or is good, and how knowledge about both is possible. Legal philosophy raises these questions with respect to the law. In so doing, legal philosophy is engaged in reasoning about the nature of law. The arguments addressed to the question of the nature of law revolve around three problems. The first problem addresses the question: In what kinds of entities does the law consist, and how (...) are these entities connected such that they form the overarching entity we call “law”? The answer is that law consists of norms as meaning contents which form a normative system. The second problem addresses the question of how norms as meaning contents are connected with the real world. This connection can be grasped by means of the concepts of authoritative issuance and social efficacy. The latter includes the concept of coercion or force. The third problem addresses the correctness or legitimacy of law, and, by this, the relationship between law and morality. To ask about the nature of law is to ask about necessary relations between the concepts of normative meaning, authoritative issuance as well as social efficacy, and correctness of content. (shrink)

Robert Stalnaker is an actualist who holds that merely possible worlds are uninstantiated properties that might have been instantiated. Stalnaker also holds that there are no metaphysically impossible worlds: uninstantiated properties that couldn't have been instantiated. These views motivate Stalnaker's "two dimensional" account of the necessary a posteriori on which there is no single proposition that is both necessary and a posteriori. For a (metaphysically) necessary proposition is true in all (metaphysically) possible worlds. If there were necessary a posteriori (...) propositions, that would mean that there were propositions true in all possible worlds but which could only be known to be true by acquiring empirical evidence. Consider such a purported proposition P. The role of empirical evidence for establishing P's truth would have to be to rule out worlds in which P is false. If there were no such worlds to be ruled out, we would not require evidence for P. But by hypothesis, P is necessary and so true in all metaphysically possible worlds. And on Stalnaker's view, the metaphysically possible worlds are all the worlds there are. So there can be no proposition that is true in all possible worlds, but that we require evidence to know. In this way, the motivation for Stalnaker's two dimensional account of the necessary a posteriori rests on his denying that there are metaphysically impossible Worlds. I argue that given his view of what possible worlds are, Stalnaker has no principled reason for denying that there are metaphysically impossible worlds. If I am right, this undercuts Stalnaker's motivation for his two dimensional account of the necessary a posteriori. (shrink)

Contemporary discussions about practical reason or practical rationality invoke four competing views which can be named as follows by reference to their historical models: Aristotelian, Hobbesian, Kantian and Nietzschean. The subject-matter of this article is a defence of the Kantian conception of practical rationality in the interpretation of discourse theory. [Robert Stalnaker] Saul Kripke made a convincing case that there are necessary truths that are knowable only a posteriori as well as contingent truths that are knowable a priori. A number of philosophers have used a two-dimensional model semantic apparatus to represent and clarify the phenomena that Kripke pointed to. According to this analysis, statements have truth-conditions in two different ways depending on whether one considers a possible world 'as actual' or 'as counterfactual' in determining the truth-value of the (...) statement relative to that possible world. There are no necessary a posteriori or contingent a priori propositions: rather, contingent a priori and necessary a posteriori statements are statements that are necessary when evaluated one way, and contingent when evaluated the other way. This paper distinguishes two ways that the two-dimensional framework can be interpreted, and argues that one of them gives the better account of what it means to 'consider a world as actual', but that it provides no support for any notion of purely conceptual a priori truth. /// [Thomas Baldwin] Two-dimensional possible world semantic theory suggests that Kripke's examples of the necessary a posteriori and contingent a priori should be handled by interpreting names as implicitly indexical. Like Stalnaker, I reject this account of names and accept that Kripke's examples have to be accommodated within a metasemantic theory. But whereas Stalnaker maintains that a metasemantic approach undermines the conception of a priori truth, I argue that it offers the opportunity to develop a conception of the a priori aspect of stipulations, conceived as linguistic performances. Evolutionary Psychology as Maladapted Psychology, Robert Richardson takes a critical look at evolutionary psychology by subjecting its ambitious and controversial claims to the same sorts of methodological and evidential constraints that are broadly accepted within evolutionary biology. The claims of evolutionary psychology may pass muster as psychology; but what are their evolutionary credentials? Richardson considers three ways adaptive hypotheses can be evaluated, using examples from the biological literature to illustrate what sorts of evidence and methodology would be necessary to establish specific evolutionary and adaptive explanations of human psychological traits. He shows that existing explanations within evolutionary psychology fall woefully short of accepted biological standards. The theories offered by evolutionary psychologists may identify traits that are, or were, beneficial to humans. But gauged by biological standards, there is inadequate evidence: evolutionary psychologists are largely silent on the evolutionary evidence relevant to assessing their claims, including such matters as variation in ancestral populations, heritability, and the advantage offered to our ancestors. Das Buch "Ethische Wirklichkeit" liefert eine Verteidigung von zwei Grundannahmen des ethischen Diskurses, die schon immer philosophischen Zweifeln ausgesetzt waren: erstens der Annahme der Wahrheitsfähigkeit ethischer Urteile, zweitens der Annahme der Vernünftigkeit der Befolgung angemessener ethischer Forderungen. Hauptbezugspunkte der Arbeit sind dabei Ludwig Wittgenstein und Robert Brandom. Mit ihnen wird gezeigt, dass die Bedeutung propositional gehaltvoller Ausdrücke auf der fundamentalen Ebene in ihren internen Beziehungen mit weiteren Ausdrücken sowie mit nichtsprachlichen Verrichtungen besteht. Mit dieser Idee wird nicht nur der (...) ethische Kognitivismus als eine unproblematische Position ausgewiesen. Zusammen mit interpretationstheoretischen Standardargumenten Wittgensteins und Donald Davidsons unterstützt die Idee zudem einen ethischen Objektivismus. Die notwendige Vernünftigkeit ethischen Handelns wird mit der These verteidigt, dass ethische Sätze im Wesentlichen dem Explizitmachen von Aspekten des geteilten Sprachspiels dienen. Das Ignorieren eines angemessenen ethischen Urteils bzw. das Nichtbefolgen einer angemessenen ethischen Forderung erscheint damit als ein Schritt über die Grenze der Intelligibilität hinaus. When making decisions, humans can observe many kinds of information about others' activities, but their effects on performance are not well understood. We investigated social learning strategies using a simple problem-solving task in which participants search a complex space, and each can view and imitate others' solutions. Results showed that participants combined multiple sources of information to guide learning, including payoffs of peers' solutions, popularity of solution elements among peers, similarity of peers' solutions to their own, and relative payoffs from (...) individual exploration. Furthermore, performance was positively associated with imitation rates at both the individual and group levels. When peers' payoffs were hidden, popularity and similarity biases reversed, participants searched more broadly and randomly, and both quality and equity of exploration suffered. We conclude that when peers' solutions can be effectively compared, imitation does not simply permit scrounging, but it can also facilitate propagation of good solutions for further cumulative exploration. Unrechtmäßigkeit des Pontifikats Gregors VII. thematisiert, ebenso die Gegenkönigserhebung Rudolfs von Rheinfelden, die Schlacht an der Weißen Elster, der Tod des Gegenkönigs sowie das Bündnis zwischen Gregor VII. und Robert Guiscard. Der Normannenherzog ist der Anknüpfungspunkt der Autorin für die Ereignisse des Investiturstreits, der Grund dafür, dass dieser westliche Konflikt für sie von Bedeutung ist. Anna Komnenes Bericht (...) erhält jedoch auch Sondergut, Ereignisse, die sich nicht mit den westlichen Quellen in Einklang bringen lassen. Ein bedeutender Teil dieses Sonderguts ist insbesondere gegen Gregor VII. gerichtet, so etwa dessen Misshandlung der Gesandten Heinrichs IV., aber auch die suggerierte Teilnahme des Papstes an der Schlacht an der Weißen Elster. Diese antipäpstliche Tendenz dominiert die gesamte Episode. Sie wird nicht zuletzt an der Art und Weise deutlich, wie Anna Komnene das Aufeinandertreffen zwischen Gregor VII. und Robert Guiscard darstellt. Sie gestaltet die Begegnung als Herrschertreffen und übt somit massive Kritik an Papst Gregor VII., der sich demnach als weltlicher Herrscher geriert. Die Autorin gebraucht die stilistischen Mittel der Ironie und des Spotts, um Gregor in ein negatives Licht zu rücken. Sie präsentiert Gregor als Erfinder unmenschlicher Strafen, als überheblichen Barbaren, als Herrscher und Feldherrn, nie jedoch als einen sich seines Amtes würdig erweisenden Geistlichen. Der Umstand, dass Gregor VII. niemals beim Namen genannt, sondern anonym lediglich als 'Papst' bezeichnet wird, ist mehr als eine 'damnatio memoriae'. Durch Gregors Anonymisierung beschränkt sich die Kritik in der Alexias nicht auf das Individuum 'Gregor VII.', sondern sie wird im Gegenteil ausgeweitet auf die institutionelle Ebene des Papsttums. Die Schlechtigkeit und Boshaftigkeit Gregors VII., also des Papsttums überhaupt, in der Alexias verstärkt sich noch, wenn man diesem Verhalten dasjenige des konstantinopolitanischen Patriarchen gegenüberstellt. Ein Vergleich des in der Alexias geschilderten Verhaltensmusters des 'römischen Patriarchen' mit dem täglich erlebten Verhaltensmuster des 'konstantinopolitanischen' drängte sich dem Rezipienten der Alexias geradezu auf, so dass das päpstliche Verhalten als ὕβρις erscheinen musste. In Kant's Human Being, Robert B. Louden continues and deepens avenues of research first initiated in his highly acclaimed book, Kant's Impure Ethics.

My aim in this article is twofold. First, I will illuminate the triangular conceptual connections between responsibility, authority, and power as they are exposed in the organizational realm; second, I will show how the three concepts are distinct. Relying on the work of Peter Strawson and his followers on responsibility for my point of departure, I will show that the connection between the inner corporational authority and its inner matching responsibility is different from the connection between the outer corporational forces (...) and influences and the CSR that they develop in reaction to these. This will expose another important distinction between two kinds of responsibility: the organizational kind, as instantiated in organizations, and the social kind, which constitutes the outer aspect of the CSR. Though many thinkers address different kinds of responsibility, a comparative perspective of these different concepts is missing. I attempt to bring three of these separate discourses together to examine them alongside one another, evaluating them in the light of their differences and similarities. This will expose a new typology of ‘responsibility’ that penetrates and illuminates the relations between corporations and society and as such enhance our understanding of organizational responsibility.
